£7,000 CLAIM DROPPED
CASE INSTITUTED BY BANKRUPT CREDITORS’ DECISION Following a report by Air. A'. N. Hubble from the Grown Solicitor’s office, creditors of Robert Ernest Odd, a contractor, decided (his morning not to proceed with a claim involving £7,000 brought against a brick and tile company. Odd instituted the claim in March last, before his bankruptcy. The case was in connection with a contract with the company trustees for the construction of brickworks. The company terminated the contract and to his loss Odd ascribed his bankruptcy. At an earlier meeting of creditors it was arranged to obtain an opinion from the Crown Solicitor’s office on the value of the case. Mr. Hubble’s report was read this morning by the official assignee, Air. A. W. Watters. “I am definitely of the opinion that the creditors should not proceed with the action,” Mr. Hubble said. “There can be no doubt that the termination of the agreement came as a surprise to Odd, but i cannot see that he has legal grounds for a claim. The position of claims made by creditors individually against the company may be different.” Mr. E. L. Bartleet, representing the company, said the concern proposed to bring the case to a head. By resolution, the creditors voted against proceeding with the claim instituted by the bankrupt. It was made clear that creditors’ individual claims would not be prejudiced.
