MISREPRESENTATION PROVED
FARMER AWARDED DAMAGES Finding that misrepresentation hud been made in negotiations for the sale of a Clevedon farm, concerning the area liable to Hooding, Mr. Justice Blair, in a reserved judgment delivered in the Supreme Court today, awarded £l5O damages and costs to the purchaser, Lmily Miriam Chestnut, against the vendor® William Peter Seaton and Alice Winifred Seaton. The sum of CSOO was claimed on the allegations that fraudulent misrepresentations had been made that w< >uld and had been carryng 30 i 1 ntl sof the year, and that the property was not subject to flooding. His Honour held that the puoporty was affected by big flood® two or three as defendant had represented that ( nlv four or fi\ - acres wen aff< < ted. The judge added that plaintiff did not suggest anywhere that the property ever carried 30 cows for 10 months of The year, and he considered that plaintiff had not proved this allegation.
