DANGEROUS DRIVING CHARGE DISMISSED MAGISTRATE’S DILEMMA Holding that there was nothing to guide him in deciding who was to blame for a minor collision that occurred on the Great North Road on August 26, Mr. E. C. Cutten, S.M., dismissed a charge of dangerous driving preferred against Noel S. Wells at the Magistrate’s Court this morning. Mr. Terry appeared for Wells, pleading not guilty, and Mr. Hogan prosecuted. Francis Frederick Augustus Roberts gave his version of the incident which had occurred near the Stone Jug at 7.30 a.m. He had been driving toward town when a lorry had drawn level and deliberately cut across his track causing a slight collision. There had been no warning and the horn was not sounded. Witness had slowed up to see that his car was all right and then chased the other car to get the number. He could not say that defendant was the man driving the truck. The men in the truck had grinned and called out some remark as they sped by. Wells, put in the box by Mr. Terras blamed the previous witness for the collision, saying that the man had made no effort to let him past, alter he had received plenty of warning b," horn-blowing. The remark that had been made as the two cars passe<J was merely a suggestion that Roberts observe the regulations monq strictly. The evidence of both com* plainant and defendant was corrot» orated by passengers in their cars. “This is a dispute between two parties, both of whom have told good stories,” said the magistrate. “ThenJ is nothing to guide me in coming to any conclusion.”
