EX-SOLICITORS’ ESTATES

METHOD OF DISPOSAL OF DOCUMENTS REFERENCE TO LAW SOCIETY “I think the procedure should be submitted to the Auckland Law Society, which is likely to be interested. MR. JUSTICE SMITH made this comment in the Supreme Court today, when the official assignee applied for directions concerning the disbursement of documents in the bankrupt estates of two former solicitors, H. R. Malcolm and John Henry Victor Man si 11. Mr. Hubble, for the official assignee, said that the estates of both former practitioners' had been investigated, and the assignee was prepared to make the final distribution of the assets. There were a large number of deeds and mortgage documents in the estates, many of which had been handed over to claimants; but there were still many documents for which owners could not, and probably would not, be found. It was proposed to offer the documents for tender to members of the legal profession in the City, as had been done in two previous cases, deeds then being bought ing by two reputable legal firms. Questioned by his Honour, Mr. Hubble said that this procedure had not been objected to by the Law Society, although it had not been submitted to it for approval.

His Honour: I thipk the proposed procedure should be referred to the Law Society, and if it approves the method, I will accept a memorandum to that effect.
