DISCHARGE REFUSED

BANKRUPT SERVICE-CAR PROPRIETOR DEBTS OVER £5.000 From Our Own Correspondent HAMILTON, Monday. Remarking that before a bankrupt was entitled to ask for his discharge he must be able to show he had committed no misdemeanour. Mr. Justice Ostler refused the application of Albert Edward Magon, motor service proprietor. Te Kuiti, for his discharge from bankruptcy. The application was opposed by the official assignee. Mr. J. H. Robertson, and Mr. Johnson. It was stated that Magon filed bankruptcy in May. 102 S. his liabilities exceeding £ 5.000. His assets had produced only sufficient to pay -2s 3d in the pound. Mr. Vernon said Magon was one of the first men in New Zealand to start the motor service business, lie was a hard working man and had himself lost £4.000 in the business. His Honour said the official assignee's report showed some unsatisfactory features. Mr. Johnson said the creditors he represented regarded Magon's bankruptcy as a very serious matter. Bankrupt had admitted that he kept no proper books, that he had never taken out a balance sheet and that he had indulged in a period of reckless trading during the seven months previous to his bankruptcy. After hearing the official assignee’s adverse report the judge said bankrupt in this case appeared to have been not only nonchalant but almost impertinent. He had piled up debts for £3.000 by what was described as recklessly plying motor-cars. The application was refused. Applications for discharge were granted to Robert Gilmour Ritchie, accountant. Te Kuiti. and William Arthur Smith, labourer. Hamilton. The application of Ernest Anie Mortensen. farmer, Piopio. was adjourned for six months, and that of Paul Collyei:. sawmiller, Kopaki, for 12 months.
