LOCAL BODIES’ ACTION FAILS Ruling that the Crown was the proper authority to bring a claim for damages to the bridge over the Kauaerauga River, connecting Thames Borough and County, Mr. Justice Kennedy, in a reserved judgment today, dismissed a suit by the Thames Borough and Thames County Councils against the Kauri Timber Company. The claim was for £2,767 to cover repairs to the structure allegedly partially , destroyed by defendant company’s logs floating down the river during a flood in May, 1924. His Honour said that the portion of the bridge damaged was in the county. The Attorney-General was not joined as a parts’, although the damaged bridge was vested in the Crown, the county being merely custodian of the structure. The Thames Borough was entrusted with no duties in connection with the bridge and could not, therefore, complain of interference. The Thames County Council’s action was not to prevent wrongful interference, hut to recover damages to the Crown’s property. Judgment was entered for defendants, with costs.
