GUARANTORS IN COURT
DEFUNCT DAIRY FARMERS’ UNION DISPUTE OVER PAYMENT (From Our Oven Correspondent) HAMILTON, Today. An unusual case began in the Supremo Court today when the guarantors of a joint and several for £I,OOO with the Union Bank of Australia took action against the remaining guarantors for their alleged failure to pay their share. The plaintiffs are Frederick William Thomas, of Te Rapa, Robert Axel Foreman, of Gordonton, and Charles Parker, of Te Awamutu, farmers. The defendants are Henry Robert John Southee, of Walton. Beauchamp Urquhart Barlow, of Motumaolio, Albert Edward Fear, of Pirongia, and John Livingstone, of Te Awamutu, farmers.
According to the statement of claim, plaintiffs and defendants, with Thomas Claude Grace, jointly and severally guaranteed to the Union Bank at Hamilton the repayment of advances made by the bank to a body known as the Dairy Farmers Union up to the extent of £I,OOO with interest, and upon the »nion defaulting payment, the bank had called on the guarantors for payments of their indebtedness, and that in all £694 7s Gd had been paid to 'he bank. Plaintiffs now call upon Grace and the defendants to contribute the proportionate amount duo by them. Plaintiffs also pray for a court order adjusting the matter to their satisfaction. (Proceeding.)
