CLOSING A ROAD

INJUNCTION DISSOLVED An interim injunction against the Thames County Council, restraining it from closing Corbett’s Road, Hikutaia, was dissolved by Mr. Justice Ostler in a reserved judgment in the Supreme Court today. The council’s petition was opposed by Jas. Handley. It was admitted, his Honour said, that all the necessary steps to close tho road had been taken by the council, and that only the gazetting of the Governor-General’s consent remained, when Handley obtained an injunction on the ground that access to part of liis land had not been provided as conveniently as Corbett’s Road. His Honour held that the court had no jurisdiction to hear again whether plaintiff had been provided with equally convenient access to his lands, or to grant an injunction restraining the council from closing the road. He therefore dissolved the interim injunction, and allowed costs to the council.
