RESENTED REMARK ABOUT POLICE A plea of mistaken identity failed at the Police Court this morning when Norman Mackay was fined £2, in default seven days' imprisonment for using obscene language in Victoria Street last evening. Mackay, a cook, aged 48. was also charged with being found drunk, Mr. Sinyth entering a plea of not guilty on both counts. A young woman, who had. been present. said that the offence was committed at Cooper's Corner about 6.30. Accused and another man had been arguing loudly when Witness had re‘ marked casually to a bystander that there was usually a constable on duty at that corner. That observation had prompted accused's outburst. Constable Mather explained that he was absent from the corner While taking a man to the station under arrest for assault. He had previously been doubtful as to whether he would an; rest Mackay for drunkenness, but,‘ having his hands full at the time, had passed him by. It was just at the time when constables warned men to‘ go home instead of arresting them. There was no doubt that Mackay was drunk. Snlylnspector McCarthy elicited the fact that accused had :21 previous convictions. 1 Mr. Smyth was of the opinion thatl the woman witness was mistaken.
