CHARGE OF THEFT

TIMBER AND MOWER James Reilly, a Mangere farmer, sued his late tenant, Thomas Blood, for theft of a quantity of timber, and a lawn mower,, to the total value of £3 10s, at the Onehunga Police Court this morning. Mr. J. J. Sullivan, who appeared for Blood, said that Reilly had given him the timber, and the lawn mower, but Reilly stoutly denied it. Evidence showed that Blood had regularly paid his rent, and had considerably improved the property. Two witnesses deposed to having heard •Reilly say that Blood could have the timber to build a fowlhouse. Mr. F. H. Levien. S.M., in dismissing the case, held that there was not the slightest evidence of theft, and that Blood had the right to the goods.
