Reserved judgment to this effect ;1 3 delivered by Mr. Justice Kennedy , -tie Supreme Court this morning, in iCas9 heard last week when Henry reea proceeded against the New m Town Board, claiming damages ; trespass to his land, an injunction the defendants from fur;«r trespass and a mandatory inaction requiring defendants to re--ore a sewer constructed by them aon the plaintiff’s land. John W. Forrest, a contractor to thtr eiendant town board, constructed for •e board a sewer, partly underround and partly overground, on the jaintiff’s land. His Honour said the board’s power ) construct drains upon or under any r-vate lands or buildings within the m district was strictly limited, and -rtain conditions as to advertising -d notification had to be complied rjtli. In this case the conditions had it been fulfilled. Having regard to all the circummces, I assess the damages nowaimed In this action at £25,” said ;;s Honour
