ABUSIVE MAN SUFFERS BROKEN JAW ASSAULT CHARGE FAILS The non-appearance of the principal witness resulted in the dismissal of a charge of assault preferred against Reginald J. Shergold at the Police Court this morning. According to the police Shergold had broken a man’s jaw and left him to fall through the window of a restaurant. Shergold was charged with assaulting Daniel South and committing mischief by wilfully damaging a window valued at £2 10s. Mr. F. W. Schramm pleaded not guilty on accused's behalf. “South had his jaw broken,” said Sub-Inspector McCarthy. “Of course your Worship may think that he was looking for it. He broke the window as he fell.” Mr. Schramm explained that South had become abusive in a restaurant and had struck at Shergold, who, to defend himself, had been forced to get in the first blow. He had turned and walked away when he saw South falling through the window. “The man was drunk,” said counsel. The name of South was called by the orderly, but there was no reply and the assault charge was dismissed. “His general habitation is the gaol. 1 think,” observed the magistrate. On the second charge Shergold was ordered to make good the damage and pay costs.
