“SAVE THE SQUARE”
CHRISTCHURCH’S LEGAL ACTION JUDGE RESERVES DECISION (Special to THE SUNJ CHRISTCHURCH, Wednesday. Decision has been reserved by Mr. Justice Herdman in the application for an injunction by the “Save the Square” Committee to prevent the Christchurch City Council from carrying out certain works in Cathedral Square. For the defence, Mr. A. T. Donnelly said some of the statements in the claim would indicate that the action was political in origin. Contending that the land had be. come a street by usage, Mr. Donnelly submitted that section 171 of the Municipal Corporations Act, 1920, was a defence to the whole action, because the council was entitled to build such a structure in the street, and the whole of the land outside the concrete and iron fence was a street under section 171. Counsel then dealt in detail with the various acts relating to the square and contended that the boundaries of the area were uncertain, as the documents relating thereto did not describe the land sufficiently.
