PROSECUTION BY COUNCIL Press Association DUNEDIN. Monday. j The Supreme Court was occupied to-day in hearing a claim by the ! Attorney-General, acting for the Mayor, , councillors and citizens of Dunedin, against the Arcade Company. During the hearing a great deal of evidence regarding the formation of the compan> and its rights in the sixties was given in an effort to discover whether the passageway through the Arcade was considered to have been private or public property. The present case is a friendly one. and the defendants committed a technical breach by thus obstructing the passageway to enable the action to be brought. It was stated the citizens of Dunedin have generally thought the passageway was public property, but the Arcade Company has always main- j taired otherwise. and that the city | never obtained any right to it, either ' legal.v or by usage.
