SYDNEY GRAFT CHARGES BABCOCK AND WILCOX APPEAL (Australian and N.Z. Press Association) SYDNEY, Saturday. The court allowed Babcock and Wilcox, Ltd.’s, appeal against the magistrate’s decision, convicting and fining the firm £I,OOO, and ordering the refund of £IO,OOO to the Sydney City Council for an alleged offence under the Secret Commission’s Prohibition Act.

The majority of the court held that while there might be a suspicion, that could never be accepted as a ground for a conviction, which should rest only upon established fact.

The penalty imposed on Babcock and Wilcox, Ltd., was an outcomeof allegations of graft concerning certain contracts, laid against some of the city aldermen. As a result of an inquiry the council was abolished and a commission set up to administer the civic affairs of Sydney.
