£669 DAMAGES GRANTED
CLAIM FOR FELLED TIMBER MILLING COMPANY WINS CASE (Special to THE SUN) HAMILTON, To-day. Alleging that the South Taranaki Building and Investment Company, Ltd., had wrongfully felled and removed timber from their property, the Bartholomew Land and Timber Company, Ltd., sued before Mr. Justice Blair in the Hamilton Supreme Court yesterday to recover £669. Plaintiff company complained that trees removed contained an equivalent of 251,085 superficial feet, sawn measurement. They were situated on a high plateau and because of defendant’s action the cost of removing the remaining trees would be higher. The amount claimed was based on the value of the timber and on the increased cost of getting the rest of the timber out. Henry Jenson. manager of the Bartholomew Timber Company’s mill at Te Whetu. gave evidence as to the taking of the timber. There was no defence and judgment was given plaintiff for the amount claimed.
