“MUST STOP,” SAYS S.M. FIREMAN GIVEN CHANCE “Brawling in the street must be stopped,” said Mr. W. R. McKean, S.M., at the Police Court this morning. “In this case, however, there seems to have been provocation.” James Loftus, a fireman, aged 32, was charged with assaulting Daniel McEwan in Customs Street. Mr. J J. Sullivan entered a plea of not guilty on accused’s behalf. According to Constable Chalcroft, Loftus had struck McEwan with his clenched fist, apparently without provocation, and felled him. Mr. Sullivan explained that McEwan had been annoying Loftus in an hotel bar. Loftus had not retaliated, but had merely pushed McEwan away when the man had accosted him in the street afterward. It was not possible for Loftus to hit McEwan with his clenched fist, as his hand was fractured and he was, in fact, receiving compensation pay for that injury. Loftus was convicted and discharged.
