BAY OF ISLANDS PETITION
♦ ELECTORAL COURT TO SIT SUPREME COURT JUDGES TO PRESIDE It is probable that the trial of the Bay of Islands electoral petition will be held at Kaikohe. Monday, January 28, has been fixed as the date, and there is every likelihood that the two judges presiding will be Mr. Justice Herdman and Mr. Justice Ostler. On the night of the Bay of Islands election, Mr. H. M. Rushworth, the Country Party candidate, was given a majority of 66 votes, but the official count reduced this to one. Later a parcel of votes that had been overlooked made a tie with 3,839 votes for each candidate, and the returning officer gave his casting vote for Mr. Bell, who was accordingly declared elected. Supporters of the Country Party claimed and were granted a magisterial recount, which took place at Kawakawa before Mr. J. H. Luxford, S.M., assisted by Mr. F. Bird, returning officer for the Marsden electorate. The result was that Mr. Rushworth led Mr. Bell by two votes, and the magistrate directed the returning officer to amend his return accordingly. The petition was then lodged.
