OWNER NOT TO BLAME
TENANT’S INJURED THUMB DAMAGES CLAIM LOST Whether an owner can be held responsible when his tenant is injured |by a falling window, said to be out of *°pair, was a question decided in the negative by Mr. F. K. Hunt, S.M.. at ! he Magistrate’s Court yesterday. Florence Calderwood (Mr. Gould) I claimed from John Henry Hannan (Mr. (Sullivan) damages totalling £4O. Plaintiff proceeded on the ground that a window she was cleaning a fortnight after entering the house, having no weights and being secured by a small rusty nail only, crashed down on her Thumb, causing severe injuries. H.innan counter-claimed for an order for the ejection of Mrs. Calderwood and her husband, urging that their rent was in arrears. After hearing a long argument between counsel, the magistrate found tor Hannan in both actions, making an rder that Mrs. Calderwood quit the Premises within a week.
