DAMAGES FOR ASSAULT
CHINESE AWARDED £2O (Special to THE SUN) WAIHI, Tuesday. A sequel to an assault on a Chinese, Ham Sing, by Ernest Edward Thompson, a young man now on probation for the offence, was a claim by Sing against Thompson for £75 damages, in the Magistrate’s Court, before Mr. F. W. Platts, S.M. Mr. Clark, for plaintiff, contended that the magistrate, Mr. F. W. Platts, should take into consideration not only the actual injuries inflicted and the pain suffered, but also all the circumstances of the assault. In view of these and the fact that the Judge had expressed the opinion that the Chinese should be compensated, he did not think his client’s claim was excessive. Mr. Clendon, for defendant, said he considered the claim was out of all proportion to the injuries inflicted. Ham Sing, he said, had been able to resume work in his laundry the morning after the assault. The magistrate said the assault was brutal and unprovoked, but looking at all the facts and bearing in mind that the Chinese had not been incapacitated, he would assess the damages at £2O and costs.
