Justice Blair in the Supreme Court toi day in the appeal made by John Rigger. Hamilton East, against „ the decision of Mr. S. L. Paterson S.M.. who awarded John Bateson, nurseryman. Hamilton, £226 damages against appellant for cutting down a boundary hedge between Rigger’s property and Bateson’s nursery. The Judge expressed the opinion that the magistrate assessed the special damages on an erroneous basis. He allowed appellant £lO 10s costs and disbursements.
