MAGISTRATE AT FAULT
JUDGE UPHOLDS APPEAL DAMAGES ON ERRONEOUS BASIS (From Our Oxen Correspondent) HAMILTON. To-day. A reserved decision was given by Air. Justice Blair in the Supreme Court toi day in the appeal made by John Rigger. Hamilton East, against „ the decision of Mr. S. L. Paterson S.M.. who awarded John Bateson, nurseryman. Hamilton, £226 damages against appellant for cutting down a boundary hedge between Rigger’s property and Bateson’s nursery. The Judge expressed the opinion that the magistrate assessed the special damages on an erroneous basis. It appeared to be the proper course to order a new trial, but he had been invited by appellant to reassess the damages himself on the evidence. He was prepared to accede if both parties, would agree. He allowed appellant £lO 10s costs and disbursements.
