SELLING RADIO GOODS
AUCTIONEER FINED £8 REGULATIONS IGNORED A decision of importance to auctioneers was given by Mr. F. K. Hunt, S.M., at the Magistrate’s Court yesterday, when, holding it was illegal for an auctioneer to sell wireless goods in the course of his business, he fined J. R. Robertson, auctioneer, Auckland. <£2 on each of four counts of having sold radio apparatus without being licensed. The action was brought by the department. After spending £IOO in advertisements Robertson held sales of radio goods on different days. Giving his decision, the magistrate said Robertson was remunerated in some cases bv a prearranged commission, and in others by the amount he could sell the goods over the invoice price, they having been sent to him “on consign ment.” He was not a licensed radio dealer nor were his premises registered for the sale of such goods. No record was kept of the names, occupations or addresses of the purchasers of the goods as required by the regula tions. Defendant had claimed that the original vendors of the goods should have been sent someone to be present at the sales to record the particulars required by the regulations. The magistrate, however, considered that the moment defendant decided to sell the goods to a certain customer he became himself the purchaser from his suppliers. The Property passed to him. and he, as vendor, resold to his customer. It was then his responsibility to comply with the regulations. Robertson was selling radio goods without a licence, and must be convicted.
