Auckland Divorce Court Busy Again
DECREES NISI GRANTED ABSENT PARTIES TO RETURN On the grounds of adultery, Bertie Edward Sparrow (Mr. Allan Moody) petitioned Mr. Justice Frazer in tho Supreme Court this morning for a divorce from Oertiude Bessie Sparrow. Petitioner said the wife’s misconduct was committed in "Wellington with Joseph Winch, fireman, of Nelson. A decree nisi, to V>e moved absolute after tho expiration of three months, was made by the Court, co-respondent to pav costs on the lower scale. ... A letter from her husband statins ho had found a better woman gave Miriam Owen Brierley (Mr. Allan Moody) grounds for petitioning: for a divorce from Henry Cooper Brierley. Petitioner said she was married in February, 1918, in England, and cams to New Zealand the following year. There was one adopted child. “In 1926 I was an inmate of the Auckland Hospital and When I came out I found my husband had left home.'' said witness. “I then ascertained he was living with a spinster at Ponsonby as man and wife. In June of this year I received a letter from him saying he would agree to a divorce, but would not disclose the name of the co-respondent.” A decree nisi was granted, petitioner to have custody of the child. * • • For her husband’s failure to with ‘ an order for restitution of conjugal rights. Phyllis Kathleen Pitcher (Mr. Mervyn Adams) was granted divorce from Leslie Herbert George Pitcher. The parties were married in May, 1919, and two children were born. The husband was ordered to return in the December sessions. 1927, but ignored the Court. Petitioner was granted custody of the children. ... Deserted by her husband, Gladys May Cooper (Mr. A. Burns) sought dissolution of her marriage with Robert Everard Cooper. They were married in February, 1916. In December, 1924, respondent said he was going to Wellington and would send for her. She next heard from him from Melbourne in February. 1925. Respondent promised to send money hut did not do so. He was now living in Sydney. A decree nisi was allowed. • * • On the petition of Annie Elizabeth Cock (Mr. Alan Moody). Lionel Lewis Cock was ordered to return within 14 days. The two were married in October, 1915. . • • Another wife who failed to return was Violet Pearl Allen, against whom Frederick George Allen (Mr. Singer) obtained an order for restitution of conjugar rights in August last. She had ignored the order. The marring© was solemnised in December, 1924. The two lived in Auckland and Sydney. A decree nisi was granted. . On grounds of desertion Frederick ; Dver (Mr. Singer) was divorced from Naomi Elsie Dyer (Mr. . Dickson) by Mr. Justice Blair.
Unhappiness in the home resulted in the appearance of Mary Simmonds , (Mr. Singer) to petition for the return of Harold Ernest Simmonds. The marriage took place in June, 1901, the couple living in Auckland. Petitioner said there had been unhappiness for many years and from time to time the husband went away. Last March ho had left home and, despite entreaties, refused to return.
An order was made requiring his restitution of conjugal rights within 14 days.
Another absent husband was William Joseph Roberts Wilson. who left Vivienne Blanche Wilson (Mr. Singer) without giving a reason. Petitioner gave evidence that she was married just a year ago and the two made their home in Avondale. In May last he suggested she should live with her' mother, which she did for a while. Visiting her husband's home one day she found the house tacked and the furniture gone. He wrote from Sydney, but was now known to be in Auckland. The court ordered Wilson’fl return within 14 days. Costs were allowed against him on the lower scale.
Married in February, 1918, and deserted in 1924, Violet Elsie Creamer (Mr. Singer) petitioned for a release from Reginald Creamer. Man and wife lived in Auckland until th<§ desertion, and in April, 1925, petitioner took maintenance proceedings. In a settlement out of Court respondent agreed to give £2 a week, but never paid a penny. Petitioner had to maintain herself and two children. A decree nisi was granted.
Lillian Christina Lydia Briggs (Mr. Singer) was freed from John Walker Briggs through her husband’s failure to comply with an order to. return, made in August last. The marriage was effected in August, 1921. There were no children.
For a reason unknown to his wife, John Gladstone McGregor ordered her out of his home on August 13 last. This morning Cecilia McGregor (Mr. McLiver) sought the Court’s assistance. Although she had written beseeching his compassion, the husband was adamant.
Mr. Justice Frazer ordered McGregor to allow his wife to return within 14 days.
