CHARGE NOT PROVED

BRICKLAYER ACQUITTED William Roderick Fleming (Mr. Mackay), bricklayer, who was tried in the Supreme Court yesterday 0,1 charges of attempted breaking and entering Smith and Brown’s furniture store, Symonds Street, and of being * rogue and vagabond, was acquitted. A jemmy was found under a flight of stairs in a yard adjoining the pre* mises. When arrested, accused had an electric torch upon him. The jury found that there was insufficient evidence to connect accused with the jemmy. The second charge was dismissed at the direction of Mr. Justice Blair.
