COMPENSATION SOUGHT FAILURE OF CLAIM In describing the injury to his right thumb, Ernest Henry Walker told the Arbitration Court to-day that in cold weather the pain he felt was like toothache. Walker, represented by Mr. F. C. Jordan, claimed compensation from Annie Endean and the Guardian Tfust and Executors Company of New Zealand for an injury suffered to his thumb while working on the . Hotel Auckland building in August 1927. Compensation had been paid until September 8, of that year, but he now made further claim on account of the disability it had caused. Dr. J. P. Hastings said a small operation was necessary to make the thumb serviceable again. Mr. T. N. Holmden, who appeared for the defendants, opposed the claim on the ground that the necessary time for making it had elapsed, and further that the injury was not a schedule one, and plaintiff had not lost capacity for work.

This submission was accepted by the Court, judgment being given for the defendants.
