Marine Minister Will Grant Baths Permit
INJUNCTION blocks way ONUS ON CITY COUNCIL Th« Minister of Marine has advised that the erection of baths at Point Chevalier under private enterprise cannot go ahead until the existing injunction against this procedure is discharged. He is prepared to issue a licence for the structure. Mr. E. H. Northcroft, who is acting for Dixieland, Ltd., telegraphed the Minister of Marine on Friday as under: “My client, Dixieland Ltd., anxious to learn as early as possible your decision re application for authority to erect baths at Point Chevalier. The company is desirous of commencing operations as early as possible so as to have structure completed in time for the approaching bathing season.—Northcroft.” The following reply was received today:— “The Minister of Marine directs me to advise you that he is prepared to issue licence for the erection of baths on the Point Chevalier beach in the position secondly applied for, namely in front of the company’s own property. The injunction against erection of the baths on the site originally approved cannot be ignored so long as it exists. The consent of the City Council to the erection of the baths on the original site would not affect the position unless the injunction were formally discharged.— Secretary of Marine.” The position now is that it rests with the City Council to take the necessary action to have the injunction discharged to enable the baths to be erected for the coming season.
