ALWAYS TOOK WRONG SIDE
MOTORIST WHO HIT CYCLIST DAMAGES FOR LINE-FOREMAN (From Our Owk Correspondent.) OPOTIKI, To-day. A claim for damages ai’ising- out of a collision was concluded in the Magistrate’s Court late last evening. Mr. H. Ferguson, line foreman, Telegraph Department (Mr. Bunkall) alleged that through the negligence of Mr. Jeffery, farmer, Waiotaht (Mr. Hodgson) he collided with defendant’s car while riding a motor-cycle. The evidence of plaintiff showed that defendant drove his car around a corner into the main road, then pulled right over on to the wrong side of the road. Plaintiff collided with the car, the motor-cycle being practically wrecked and himself hurt internally. At the time of the accident defendant admitted he was in the wrong.
The evidence of the defence claimed that plaintiff was travelling at a very high speed, and in his endeavour to let the motor-cycle past he pulled to the right-hand side of the road. Plaintiff admitted that on previous occasions he had pulled to the wrong side to let vehicles get past, as he thought traffic oil the main road had the right of way. Mr. E. C. Dewy, S.M., said the defendant apparently followed his usual practice of pulling to the wrong side of the road, putting plaintiff in a position of emergency. Defendant would have to pay the costs of his actions. Judgment was given plaintiff for the £l7 10s.
