A TEST CASE

MOTORIST CHARGED SPEED AT INTERSECTION A test case under the new motor regulations was heard at the Onehunga Police Court this morning before Mr. F. H. Levien, S.M., when Eric B. Canham was charged with speeding across the intersection of Queen and Captain Streets, Onehunga, at the rate of 29 miles an hour. Mr. H. A. Yockney, town clerk of Onehunga, prosecuted and Inspectors Crichton and Wilkinson gave evidence as to checking the speed. Mr. Holmden appeared for the defendant, and urged that the facts should be restricted to Regulation 15, clause 3 under the table speeds. The Magistrate said that the defendant might be guilty of breaches of half-a-dozen other clauses, and if the Court thought this, its judgment in the interests of justice should not be restricted to any particular clause in the regulations. The clause under which the defendant was charged allowed for a clear vision of 90 feet, but John Park, in giving evidence, said that at the request of the Auckland Automobile Association he had checked the measurement and found that he had an unobstructed vision of 131 ft. at this particular intersection. The Court adjourned to enable the Magistrate to inspect the locality. On resuming, the Magistrate agreed that the defendant had a clear view, and dismissed the case.
