EFFECTED THE SALE
AGENTS’ CLAIM UPHELD Claiming £225 commission on the sale of a property in Quay Street to the Harbour Board for £9,000, Samuel Vaile and Sons, Ltd., land agents, proceeded against Harold M. Warner, engineer, in the Magistrate’s Court yesterday. For plaintiffs, Mr. I. J. Goldstine contended the true test of an agent’s right to commission was whether or not the agent introduced the buyer, so that through his agency the transaction was substantially effected. T'he plaintiff company had done this, and it was entitled to judgment for the amount claimed. Mr. Ready, for defendant, said that the purchaser was first found by defendant and that if plaintiffs were entitled to any payment at all it should be only a quantum meruit. It was further alleged a servant of plaintiffs had agreed to accept £IOO as payment for services rendered and that this arrangement was binding on the firm. Mr. E. C. Cutten, S.M., was satisfied plaintiffs had effected the sale. Judgment was entered for the full amount claimed, with costs.
