POWDER-PUFF CASE
SETTLED OUT OF COURT The “powder-puff case,” which occupied Mr. Justice Reed and a jury in the Supreme Court yesterday morning, terminated abruptly when, after the luncheon adjournment, counsel effected a settlement out of court. The action was brought by E. B. Tolley and Co., of Sydney (Mr. McVeagh) against E. H. Little and Co. (Mr. Leary), for payment of a promissory note for £262 in respect of the sale of the lease of a factory and two shops in Auckland. The defendant counter-claimed £I,BOO, alleging misrepresentation. Part of the business concerned the manufacture of powder-puffs. Tolley was stated to have said that Little would have no difficulty in selling 14,500 puffs a week in New Zealand. Little found he could dispose of nowhere near the amount.
