SAMOAN DEPORTATIONS
HON. 0. F. NELSON’S APPEAL DISMISSED FURTHER ACTION PROBABLE A private letter from Sydney states that the appeal of the Hon. . O. F. Nelson against his deportation from Western Samoa by the late Administrator, General Sir G. S. Richardson, in December last, was dismissed by the Privy Council on the grounds that the Administrator was an executive and not a judicial authorThe decision of the Appeal Lords indicated that a further applicaton might be considered when the legal tribunals in Samoa and New Zealand had been tested out. Mr. Nelson is also appealing against his removal from the office of elected legislative councillor on account of his absence, and is arguing that his non-attendance has been forced upon him by the Administrator. Mr. Nelson will probably return to Sydney shortly, and it will then be decided whether the proceedings to upset the deportations will be initiated in Apia or New Zealand. In either case Air. Nelson will probably be represented by Dr. H. E. Evott, K.C.. of Sydney, who was AttorneyGeneral in the Lang Administration, and appeared for Walsh and Johanson in the Commonwealth High Court when deportation orders against the officials of the Seamen’s Union were cancelled.
