DID NOT LOOK OUT
INCIDENT AT LEVEL-CROSSING HAMILTON LORRY DRIVER FINED (From Our Own Correspondent.) HAMILTON, To-day. The Railway Department proceeded against John Studd, lorry driver,, in the Police Court to-day for falling to keep a vigilant lookout at the Victoria Street level crossing, and crossing while the line was engaged. For the Crown, Air. H. T. Gillies called six witnesses, all of whom swore that Studd drove his lorry over at 5.40 a.m. on March 14. Air. J. F. Strong, for the defence, claimed that defendant had shown gross negligence in failing to notify accused of any breach till two months late. Counsel attempted to prove mistaken identity, but AJessrs. B. C. Lowry and R. T. Reid, J.P.’s, held that the evidence of the Crown was conclusive. Defendant was fined £1 and costs £ 3 12s.
