JUDGE’S RULING Press Association. WELLINGTON, To-day. Judgment was given to-day by Mr. Justice Sim in the Supreme Court in the case of the Public Trustee versus Balkin and another concerning the will of the late Mr. E. C. Balkin, tobacconist, who died in 1914. He found that defendant had not attained an indefeasible vested interest in the estate and would not do so until after the death of the testator’s widow. He also found that as the testator’s married daughter died before the period of distribution, leaving the issue surviving her, the interest vested in her passed to her children. Costs were to be paid out of the estate.
