ENGINEER’S CLAIM OPPOSED SUPREME COURT ACTION The hearing of the claim by Messrs. *!• Wildridge and Sinclair, instating engineers, for £226 12s 6d for work carried out, and opposed by Radley and Co., fruit merchants, was continued before Mr. Justice Blair in the Supreme Court this morning. Defendants counter-claimed for £661 3s lid for loss suffered and general damages, alleging that the work had been unsatisfactorily carried out, was defective, and the insulation plant installed was substantially useless. An effective insulating plant for coolstorage was required by defendants, said Mr. G. P. Finlay, as the original plant leaked brine into the storey below. The managing director of Wildridge and Co. claimed he could greatly improve the plant and reduce expenses by adopting a new lay-out. He was instructed to proceed with the work, no price being fixed. It was contended that the work was unsatisfactory from the commencement
The statement made by plaintiffs was that they were employed to do certain work and did it satisfactorily. They alleged that the defects in the plant arose out of work done by independent contractors, for whom plaintiff was not responsible. (Proceeding. >
