CLAIM FCR £1,079 DAMAGES ACCIDENT AT MANGERE A claim involving the sum of £1,079 was heard before Mr. Justice Blair and a jury of 12 at the Supreme Court yesterday when Charles Baker, labourer, of Onehunga (Mr. Finlay) proceeded against Thomas Gardiner Exton, salesman, of Papatoetoe (Mr. Leary) for damages arising out of a motor collision. Plaintiff claimed on the grounds that defendant had been guilty of negligence in coming across the line of traffic in Coronation Road at the intersection of Mclntyre Road, Mangere, on Jly 30, and in cutting the corner after failing to give due warning. The defence was that defendant had exercised due care in watching the road, but that plaintiff was travelling at an excessive speed and came upon him so suddenly that an accident was unavoidable. The jury was taken out to the scene of the accident before evidence was heard.
