LONG DELIBERATION
JURY OUT FOUR HOURS PRINCIPLES SACRIFICED It was only after an adjournment oi : nearly four hours that a verdict for plaintiff was returned in a civil action at the Supreme Court yesterday. The ca.se was one in which W. C. Bickley, of Henderson, and his wife, Lydia Bickley (Mr. Hall Skelton) claimed £637 damages arising out of a collision with a motor-truck driven by an employee of defendant, W. P. Levy, of Glen Eden (Mr. Finlay). The accident took place in Great North Road, between New Lynn and Waikumete Cemetery, on December 12. When the jury retired at 5.20 Mr. Justice MacGregor took the unusual course of not allowing a tea adjournment. It; was not until shortly after nine o’clock that the jury returned with a finding that the motor-lorry driver had been guilty of negligence, and assessing the damage to plaintiffs at £l5O. The verdict was by a majority of nine to three. “It was only after a great struggle,” said the foreman. “Two of the jurymen had to sacrifice their principles entirely.” “I am sorry to hear it” said his Honour. Verdict was entered for plaintiffs in accordance with the finding.
