JURY NOT CONVINCED
THEFT OF TOOLS ACCUSED FOUND GUILTY Found guilty yesterday afternoon on 10 charges of theft of carpenters’ tools, William Henry Higgins was remanded for sentence. Higgins appeared before Mr. Justice MacGregor in the Supreme Court yesterday, and pleaded not guilty to the charges of theft, and alternative charges of receiving the property. Mr. Hubble, for the Crown, said the tools had been taken from partly completed houses on the Westmere Estate. Grey Lynn. Many of the ,of which the total value was £56, had been traced to accused’s home, while others had been found in pawnbrokers’ shops. Evidence in support of the Crown was given by nine carpenters who had suffered the loss of tools. Mr. Wyatt, for the accused, said the defence was a denial of the charges. He thought the tools must have been .put in his house by his father-in-law. who was now dead. During cross-examination the accused admitted that he had been fined for theft in Napier, and had served a sentence for making a false declaration. Summing up, his Honour said it seemed to him that the explanation was as bad as the original offence.
