“FORCED TO CRIME BY SHEER NECESSITY”
COUNSEL'S PLEA FAILS ‘•Sheer necessity forced this man into crime/’ said Mr. J. F. W. Dickson, when appearing for J. Collins, alias Frank Howie, alias Frank Henry Guhl, alias Brandon, who appeared for sentence in the Supreme Court this morning on 15 charges of breaking, entering and theft, and false pretences. Mr. Dickson said that probation was out of the question, but he would ask that the sentence be as light as possible. The prisoner committed his first offence in Wellington 18 months ago. when he got into company with an old Australian associate. He came to Auckland and had to keep out of the way of the police because of that offence. He was eventually forced to steal to get sufficient to live. Mr. V. N. Hubble, for the Crown, said that the prisoner started his criminal career in 1921. A significant fact was that a complete burglar’s outfit ‘ was found in his possession. Prisoner admitted to his Honour that he had several convictions in Australia. “It is my duty to impose a substanstial sentence,” said Mr. Justice MacGregor. “and I hope it will do you good. You will go to gaol for two years on each charge, the sentences to be I concurrent."
