TAXI COMPANY S APPEAL DAMAGES IN MOTOR ACCIDENT Press Association. WELLINGTON. Monday. Decision was given in the Appeal Court to-day in which the Black and White Cab Company. Ltd.. appealed against the decision of the Supreme Court in refusing a new trial of the case in which Thomas Vernon Anson, of Lower Hutt. was awarded £1.157 6s 2d damages against the company as the result of a motoring accident. The judges stated that the first question to be decided was whether the appellant company was entitled to have judgment entered in its favour, notwithstanding the verdict of the jury. Their Honors were of opinion that the judge in the court below was right in dismissing this motion, for the court had no power to make such an order. The other question was the motion for a new trial. Their Honors held that Air. Justice Macgregor. in dismissing this motion in the court below, had attached too much weight to the fact that the jury had viewed the scene of the collision. A motion for a now trial was allowed, with costs on the highest scale. Leave to appeal to the Privy Council was granted, on the motion of counsel for respondent, security being fixed at £SOO.
