At the Supreme Court, John IL TCerr, aged 14 years, was awarded £1,120 damages against David Baird, a contractor, for injuries received through being knocked down by a motor-lorry, which passed over his leg. Medical evidence showed that the boy had undergone four operations, and that his foot might require amputation. The question at issue was whether the defendant, in passing, had allowed the boy, who was cycling, sufficient room. Mr. Justice Sim said that, as the road was wide enough, there was no need for defendant to be so far over to his left side, when* passing. No driver was entitled to sail so close to the wind.” He should have provided a proper margin of safety.
