BUS COMPANY TO PAY
CYCLIST COMPENSATED (Special to THE SUN.) NEW PLYMOUTH, Wednesday. Damages for the full amount claimed, £1,29S 10s 4d, 'were awarded by the jury in. the case in which Thomas McLeod White sought damages from the United Bus Company, of Auckland, for injury alleged to have been caused through the negligence of Alfred Henry Smith, a busdriver. A collision -occurred between one of defendant’s . buses and a nTotorcycle on which the plaintiff was a pillion passenger, at the foot of Big Jim’s Hill, near Waitara, last February. White subsequently had his right leg amputated. His Honour pointed out to the jury that it was negligence for a bus-driver to occupy more of the road than he was entitled to and thereby prevent other persons from passing without taking the risk of going off the metal or running into the bus. If one motorist drove negligently it was the duty of the other to do all possible to avoid an accident.
