YOUNG MOTORIST ESCAPES FINE GIVEN BENEFIT OF DOUBT F. E. L. Power, the young motorist who has achieved more than ordinary notoriety for various breaches of city by-laws, appeared at the Traffic Court yet again when he was summoned this morning to answer a charge of driving his car since the cancellation of his licence on November 9. Inspector Threadgold, of the One Tree Hill Road Board, said that on November 12 he was attending a fire at Panmure when he noticed Power’s big racing car there. Knowing of Power’s recent heavy fine and prohibition to drive for a year, he became suspicious. When the fire was out the car moved off and witness jumped on the step, and accused Power of driving the car. Giving evidence Power said he had not driven since his prohibition, but his car was being run by one Simpson. On the night of the fire this young man was driving, he himself being merely a passenger with his aunt and cousin. He said that after cranking the machine he jumped in to be followed by Simpson, who took the wheel at once. It was then that the inspector mounted the car as it was moving off. Corroborative evidence was called by Mr. Luxford for defendant. The magistrate, Mr. F. K. Hunt, S.M., said that there was some doubt in the facts and would give Power the' benefit of it. The information was dismissed.
