APPEAL BY OFFICIAL
PROTEST AGAINST FINE CASE DISMISSED Press Association. WELLINGTON, To-day. Before Mr. Justice MacGregor, in the Supreme Court, an application for the issue of a writ of mandamus against the Post and Telegraph Board of Appeal was made by James Alexander Elliott, postal official, who pleads that he had been fined £lO for accepting a, post-dated cheque for £SO in October, 1925. one of a series of valueless cheques by which William Smith end Sidney Eric Baume fraudulently secured £l,llO, of which £1,026 was recovered. Elliott pleads that he followed the departmental regulations and should not have to pay the fine. The Appeal Court had refused to proceed with the hearing. The department sets out several grounds why the application should fail, among which are that the £lO was not a fine, but Elliott’s share of the missing amount, £B4 of which had to be made good by the officials concerned. The Judge dismissed the application.
