RATE DISPUTE
CLAIM AT WHANGAREJ COUNCIL DEFEATED (From Our Oxen Correspondent) WHANGAREI. To-day. At yesterday’s sitting of the ’Vrh ?n garei Magistrate’s Court, J. Devlin was sued by the Whan garei Count* Council for the recovery of X 8 16s li the amount due on his 1926-27 rates. Mr. H. C. Hemphill, countv clerk, said the rates paid by defendant were for 1925-26 period but owing to a mistake of a girl in the office the receipt had been made out as for 1926-27 Devlin produced the receipt affixed to the 1926-27 demand to which he said he had drawn the cashier’s attention Especially for trust reasons he had to pay 1926-27 rates, although 1926-zs period yet remained unpaid. The magistrate said moneys paii for any specific purpose could not be appropriated for any other purpose, and the 1926-27 rates had undoubtedly been paid, therefore judgment must be given for defendant, with costs against the council.
