TWICE-PAID RATES
A LEGAL ABSURDITY Press Association. HASTINGS, Friday. A peculiar legal absurdity was disclosed at the meeting of the Hastings Borough Council. A ratepayer and his solicitor, unknown to each other, paid a rate demand, and the ratepayer now demanded a refund. The Mayor, quoting legal opinion, said the council had no power to refund, and that the crediting of the sum to next year’s account would amount to a refund, and would be illegal. Money could not be taken from a borough suspense account under present legislation, and if a refund were made by the council members would personally be responsible. The council was not the owner of the money, and could not use it. It belonged to someone else, but that person could not get it back. It was resolved to urge that the Act be amended.
