STAMP DUTIES

POWER BOARD CHARGED AMENDING LEGISLATION The Assistant Commissioner of Stamp Duties has decided to charge the Waitemata Power Board stamp duty on the transfer of the Devonport Electric Power undertaking to the Waitemata Board. The board is actively endeavouring to have the section of the Electric Power Boards Act amended to safeguard itself. The department takes its stand on the argument that the word “contract” in the clause providing that no stamp duty shall be charged on contracts between a power board and any other local authority not include “transfer.” The board, proceeding on legal advice that the duty is likely to be a substantial amount, is endeavouring to have the clause amended.
