TAXATION PROBLEM FOR APPEAL COURT
INTERPRETATION OF GIFT Press Association. WELLINGTON, To-day. The Appeal Court to-day is considering the case of the Commissioner of Stamps v. Olive Finch, an appeal from the judgment of the Chief Justice, Sir C. Skerrett in Wellington. The case sets forth that respondent's husband had spent £1,982 just before his death in improving the family home and the commissioner claimed this was a gift to the wife. Sir C. Skerrett held that as Finch died suddenly when he might have expected to live many years, the expenjditure was justifiable and for the husband’s own benefit. From this decision the commissioner appeals. Mr. Fair, K.C., appears for the appellant, and Mr. Parry for the respondent. Decision was reserved.
