“A BAD BARGAIN”
DISPUTE OVER PROPERTY PLAINTIFF AWARDED £2,700 A dispute regarding: the sale of a farm at Kaiw&ka early in 1925 was concluded in the Supreme Court yesterday afternoon before Mr. Justice Stringer. The plaintiff, Thomas Judd (Mr. Prendergast), sold a property of 936 acres to William Coulter (Mr. A. Gray, K.C., and Mr. Wallace) and claimed £2,700 purchase money and interest. A counter-claim for £2,000 damages for alleged misrepresentation was brought by the defendant. After lengthy evidence, his Honour said he sympathised with Coulter, who he thought had made a bad bargain. However, Coulter nad accepted a reduction of £SOO from Judd and had agreed to withdraw all claims of misl epresen tati on. At a later stage he had agreed to a further reduction of £2OO. He was not prepared to find Judd guilty of fraud and would dismiss the counterclaim. and give judgment for the full amount of the claim, with costs.
