It was stated that defendant's a*dition was first noticed by the trail inspector, who, with another person was satisfied that he was drunk ar, not fit to be in charge of the car. Police witnesses confirmed, this, st.-, ing that defendant was staggering ar drunk. Mr. Tomkins, who appeared lor tU defendant,, stated that he drove froi i Auckland to Cambridge on the da\ in question and transacted legal bm ness very satisfactorily. The onl\ evidence tendered was that fever, frot 1 which he suffered was a type of malarial complaint with muscular rheu matism, and affected the ioints of ti body.
