DIED INTESTATE
HARKER WILL AGREEMENT ARRIVED AT (From Our Own Correspondent) HAMILTON, To-day. An action involving considerable litigation was withdrawn from the Supreme Court at Hamilton on Saturday, when it was announced that a settlement had been reached in the case in which Annie Margaret Wheeler, of Frankton, sought to have set aside the will of the late Mrs. Helen Harker. Plaintiff was one of the lawful children of John and Helen Harker. deceased, and the defendant, Ellen Lavina McCarthy, who was adopted by Helen Harker in 1913, was a beneficiary under the will. James Harker died intestate on May 27, 1904, and the Public Trustee administered the estate. Mr. N. Johnson intimated to Mr. Justice Herdman that the parties had agreed that the court should make a declaration that the land set out' in each statement of claim was held in trust by deceased at the time of her death for Mrs. Wheeler, Mrs. Hayter and Mr. Simm Harker. An order was asked for in terms of the settlement, all costs to be paid out of the estate. The case was formally adjourned until Monday, pending the drawing up of a complete agreement.
